Welcome to AI Notebook - LM Podcast Maker ("App"), provided by INVENTIVE OTTERS S.R.L ("we," "us," "our"). These Terms and Conditions ("Terms") govern your use of our App, which allows users to upload PDF files and generate podcasts. By accessing or using AI Notebook - LM Podcast Maker, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our App.

1. Acceptance of Terms

By downloading, accessing, or using AI Notebook - LM Podcast Maker, you confirm that you have read, understood, and agree to be bound by these Terms, as well as any other applicable laws and regulations. If you do not agree with any part of these Terms, you must discontinue use of the App immediately.

2. Description of Service

AI Notebook - LM Podcast Maker is a subscription-based mobile application that enables users to upload PDF files to generate podcasts. The App offers both free and premium subscription models:

• Free Version: Users can generate a limited amount of podcast minutes using basic features.
• Premium Subscription: Subscribers receive additional minutes weekly, access to higher-quality voice models, and enhanced customization options.

All generated podcasts are available only to the user who created them or via a unique share link. Uploaded PDF files and generated podcasts are automatically deleted 24 hours after upload.

3. Subscriptions and Billing

AI Notebook - LM Podcast Maker offers the following subscription plans:

• Weekly Subscription: Users are billed weekly, providing a set number of podcast generation minutes.
• Yearly Subscription: Users can opt for an annual payment plan with additional benefits and discounts compared to the weekly subscription.

Billing and Payment: All payments are processed through the app store associated with your device (Google Play Store or Apple App Store). By subscribing, you authorize INVENTIVE OTTERS S.R.L. to charge the subscription fee to your payment method on a recurring basis until you cancel. You are responsible for ensuring that your payment information is accurate and up to date.

Cancellation: You can cancel your subscription at any time through your app store account settings. Cancellation will take effect at the end of the current billing cycle. No refunds will be issued for partial periods.

4. User-Generated Content

AI Notebook - LM Podcast Maker allows users to upload PDF files and generate podcasts using AI/ML technology. The content generated is considered "User-Generated Content."

• Responsibility: You are solely responsible for ensuring the uploaded PDFs and generated podcasts do not infringe on any third-party rights, violate applicable laws, or contain offensive, defamatory, or otherwise inappropriate material.
• Ownership: While the generated content is created using our App, we do not claim ownership of the content. You retain rights to your uploaded files and generated podcasts.
• Indemnification: You agree to indemnify and hold harmless INVENTIVE OTTERS S.R.L. from any claims, damages, or expenses arising from your uploaded files or generated podcasts, including intellectual property infringement claims.

5. Data Storage and Security

Uploaded PDF files and generated podcasts are automatically deleted 24 hours after upload. We implement robust security measures to protect your data during processing but do not guarantee absolute security. By using the App, you acknowledge and accept this.

6. Use of Third-Party Services

AI Notebook - LM Podcast Maker integrates third-party services, including Firebase for backend infrastructure and AI/ML APIs for podcast generation.

• Firebase: Firebase is used for managing the App's infrastructure, including user authentication and storage. Firebase may collect anonymous usage data to improve service performance.
• AI/ML APIs: External AI/ML APIs are used to convert PDF content into audio. By using AI Notebook - LM Podcast Maker, you agree that these APIs are necessary for the App's functionality, and we are not liable for their limitations or disruptions.

We ensure these third-party services comply with applicable data protection laws. Your use of these services is subject to their respective terms and privacy policies.

7. Limitation of Liability

To the fullest extent permitted by law, INVENTIVE OTTERS S.R.L. disclaims all liability for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App. This includes, without limitation:

• Errors or omissions in generated podcasts.
• Unauthorized access to uploaded files or generated podcasts.
• Service interruptions or technical issues.
• Any bugs, viruses, or other harmful components transmitted through the App.

By using AI Notebook - LM Podcast Maker, you acknowledge that your use of the App is at your sole risk.

8. Governing Law

These Terms are governed by and construed in accordance with the laws of Romania, without regard to its conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts located in Romania.

9. Changes to These Terms

We may update these Terms from time to time. Changes will be communicated by updating the "Last Updated" date at the top of these Terms and, if necessary, through additional in-app notifications. Your continued use of the App after changes signifies your acceptance of the updated Terms.
